Kagan, Yippee, sort of kinda

So folks, we've been silent on Kagan. We are happy to see a third women on her way to The Court, BUT with Ginsberg's diagnosis of pancreatic cancer and a shaky outlook for Scary Barry in 2012, our money is on Ginsberg stepping down and then.... only IF Obama appoints another women to take her place will I give him an iota of credit. We most likely will see a return to the 20% rule that is the female condition.

In reading about Kagan, it seems she exactly fits the Obama mold: extremely pro affirmative action and extremely ambivalent or perhaps a bit hostile to abortion rights.

WASHINGTON (June 29) -- The Supreme Court ruled Monday that white firefighters in New Haven, Conn., were unfairly denied promotions because of their race, reversing a decision that high court nominee Sonia Sotomayor endorsed as an appeals court judge.
New Haven was wrong to scrap a promotion exam because no African-Americans and only two Hispanic firefighters were likely to be made lieutenants or captains based on the results, the court said Monday in a 5-4 decision. The city said that it had acted to avoid a lawsuit from minorities
